Camp Owner Liability

    A question has come up at our annual meeting and I'm wondering if any members might have an answer.  The question is: If a tree falls across our camp road and we have to pay to get it removed, should we be able to get reimbursed by the camp owner on whose property the tree was located?  This has not been an issue, yet, but there are one or two large, rotten trees along the road that we're concerned might come down.  The property owners have not been willing to be proactive at this time.  Your input would be appreciated.

    First, I don't believe the "law" (Title 23) covers rotten trees or who should pay for their removal whether they have fallen and blocked the road or not. This is a maintenance issue that should be brought up before the association members at your annual meeting.

    Second, I feel that since the "emergency" has not yet occurred and if a majority of the members believe the situation is of consequence, the association officers should negotiate with the property owner involved and perhaps find a way to share in the expense of removing the trees. That way everyone wins to a degree. Good luck.
