    As a member of the Holiday Shores Road Association in Denmark I am tasked with researching the matter of  updating our legal structure to bring us into sync with the current statute.  We are in central western Maine.  I do not ask for "recommendations".   I would however appreciate knowing of any that you know of in this general area who may have experience in dealing with these matters.   Thanks, Jim

    Which current statute are you refering to? Is it Title 23 or Title 13-B?

    Thank you for getting back. 

    We want to become a properly constituted statutory road association as defined under Private Way Law: Title 23:3101-3106 :.   The group formed in 1969 attempting to  do so under the then existing legal requirement.  Related documentation is missing.   They met for  several years and then ceased to function.  It became an ad hoc situation.  They then operated on an ad hoc basis until five years ago when it was recognized that unpaid assessments had become a real problem.  We've been struggling for the past four years to accomplish the task.  The non-payers are numerous and vocal.  No property has ever been liened. 

    It would seem likely that to have the assistance of an attorney acquainted with the related issues would be helpful.   Presumably there are good people in the Bridgeton- Fryeburg area. 

     

    We're also interested in obtaining information about liability insurance.   One of the posts on this sight mentioned an insurer located in Presque Isle.   I need to follow up on that matter as well.

     

    Any thoughts you may have to share will be much appreciated.

    Jim, I notice that you inquired about liability insurance. I suggest you contact Mrs. Farthing at 207-756-5959  or tfarthing@ChalmersInsuranceGroup.com who might be able to assist. I purchase such insurance for my Statutory Road Association from Chalmers and believe the cost is reasonable. You of course can negotiate your own deal. (Tell her Peter sent you!) Good luck.
