Is insurance really necessary?

    We are a new road association with 4 families who all have our own homeowners insurance with umbrella policies. The association itself has no equity as our dues are $1 per year (we just split the bill for road work and plowing).  Is liability insurance really necessary? Wouldn't the homeowner's insurance for the person who owns that portion of the road cover any liability? Thanks, Eileen

    Just a quick thought:

    You didn't say whether or not you were organized as a Title 23 Road Association or a nonprofit  corporation. It appeared you may be just an "ad hoc" association with shared expenses.

    If you are either a Title 23 or a nonprofit it could be a good target for any legal action in addition to you private land owners.

    Advice from a good attorney is suggested.

    You might want to have each of the four home owners ask their insurance company what they are covered for.  You may find none of them will protect you against issues with the road.  If that's the case, it would be advisable to look into how much it would cost to get a policy specifically to cover issues with the road.
