Requesting review of our by-laws and declaration of covenants

    Our association is reviewing our by-laws, a task that has not been undertaken since it was formed in 2002.  I have recently joined MARA and am looking for input/insight and anything that stands out as problematic or could be challenged.

    A little history:  Our homeowners association, the Hopkins Pond Mariaville Homeowners Association, was created when Champion Paper Co sold leased lots to the owners.  Modest camps were built up along the shore and are used seasonally.  Champion deeded every lot with with covenants which requires homeowners to maintain the road.  The road is considered public (American Forest Management is responsible for managing the forest lands behind the camps and refused to put up a sign saying PRIVATE) though our town does not do any maintenance or snow plowing.  Out of 57 lots on our side of the pond, only four owners are year round residents and they contribute individually and informally to one of the homeowners who plows the three mile road and some driveways.  One lot owned by the association is considered “unbuildable” and has a public boat launch.

    I will attach our by-laws and the Declaration of Covenants (which defines terms and  spells out certain rights and responsibilities for each homeowner).  I thank you in advance for your time to review our documents.
