Collecting on Non-payment of Dues

    We are a non-profit road association incorporated in 1935.  Under our by-laws (July 1985) we are charged with, among other things, maintaining “the improvements accomplished by the Association” – essentially the maintenance and repair of our private road.  Other duties of the board of directors include “care, upkeep…of the subdivision and the common areas and facilities” and “collection of dues and special assessments from the members”.   However, our by-laws could be read to imply that membership is voluntary, even though all subdivision residents use the road as the only method of ingress and egress from a state highway.  Can we pursue subdivision residents for non-payment of dues given these circumstances?  All of our dues go toward maintenance of our private road.
