Where to find a sub-division's By-Laws

    There are two sub-divisions on our private road. The first 5 lot sub-division is off the main road but does not contribute anything to the maintenance of their portion of the road. There are three year-round residences on it. Our 10 lot sub-division is a non-profit Association and must pay a fee for maintenance and plowing for our portion of the road. 

    The problem is that the snowplowing guy lives on their portion of the road and charges us for their portion of the road in addition to our portion, meaning we have to pay everything -including maintenance. 
    They refuse to pay.

    ~ Can we make them pay? If so, how?

    ~ How can we find out if they are an Association with By-Laws and what they are?

    I believe most subdivisions have plans recorded at the Registry of Deeds which you could review; sometimes the bylaws are also recorded. Depending upon the age of the subdivision the town should have data of the project; see the town's Code Enforcement Officer. Also, review some of the deeds which should provide information on any required association.

    If you are friendly with any of the owners just ask them.
