Are motions legally binding?

    Hi- We are wanting to collect monies from resistant members.
    In the past we have passed motions indicating what is to be expected.
    Should we have these as By-laws?

    If you have organized under Maine statute, assessments are collectible in court. The MARA manual (on this website under "Leadership Manual") is important reading on this. If you do not have by-laws, you should. However, the by-laws will not say what the assessments are at any given time and a motion must be made and a majority vote obtained. The main thing about organizing under the statute is the notification of the meetings sent out when forming; how the meeting is conducted.... But if you do organize correctly under the statute, you can collect.
