    We had our first meeting last August, with a majority of residents present, to form a road association.  An attorney presided and we elected officers.  Do we need to be incorporated to be covered under the private ways statute?

    You do not need to be incorporated as a nonprofit. However, if you look at the leadership manual on this site, I believe you will read that being a nonprofit conveys certain immunities to the officers and may be desirable.
