Who can form a "Statuotry Road Association"?

    I am in the midst of trying to find a solution to a half mile section of road I must travel over to get to my home.  Interestingly enough, I live on a public, town maintained road.  The half mile section of non-public road is in another town and there currently is no road association that claims responsibility for maintenance and collection of due.  Trust me that I spend hours drying to provide all of the specifics around this road and still not cover every angle and element of the history.

    Bottom line, I think the best course of action is the formation of a statutory road association intended to address the half mile section of non-public road.  I benefit from the half mile section of road, but I do not abut the section.  As an individual that only benefits from the road and not an abutter, can I be one of three parties that work to form the road association?  Want to learn more about my situation?  Look for my Facebook page:  Sensible and Realistic Solutions for Gore Road.  

    I look forward to the feedback.  Roberta has stated to me that the three parties that form the road association do not have to be abutters, only benefit from the road.  Thanks!

    To my best knowledge, you only have to benefit from the road, not necessarily be an abutter. We had properties in our association that did not abutt nor required access to our road and never used our road, but because of the way the deeds were written they had rights to use our road. Because of this it was considered that they "benefited" and our lawyer told us we must include them as members of the association (unless they gave up rights).

    Be sure when you send out meeting notices make sure you include everyone that benefits.
