Please help me with my maintenance fee plan

    Hi, I'm in charge of writing up what the annual fees will be for our road association.  However, I want to do this right so looking for advice on how and where to state it.  Does it go in the bylaws? 

    I'd like it to read something like:
    All residents and parcel owners of Anthoine Road are hereby required to pay $200.00 in maintenance fees due by May 31 of each year.  There will be a late payment interest penalty of 1.5% per month on all assessments not paid by may 31.  Per the adopted bylaws, the annual maintenance fees are subject to change.

    Speaking from a Statutory Road Association point of view I offer you the following:

    You mention By-laws.  If you have them that is great but it makes it cumbersome to put an amount of dues in there because any changes will require a By-law change.  I think your mention that dues may change in the By-laws further confuses this issue.  If you are going to mention dues in the By-laws I think it should just state by what method dues are assessed (road frontage, one amount for all, etc.), when they are due, late penalties and possibly what actions MAY be taken to pursue delinquent dues.  As far as changing the dues amount, I think to keep it simple you would just put it in the warrant/agenda for your next meeting what you propose to do and that there will be a vote on it.

    I agree with the above. You don't want to have to change the by-laws every time you change the fees. But good work getting this out to the membership to vote on.

    Thank you so much.   This website is fantastic.  Is voting on dues the norm or is it usually determined by the board members? I feel like if it was determined by a vote, people would haggle it down to as little as possible.

    Usually, your road commissioner or board would draft a proposed budget and submit it to the owners to adopt at the annual meeting.
