right of way question

    Right of way question.  Can we limit heavy logging traffic on our private road?  A developer bought a large parcel of land after the dead end of our private road.  We do not want logging trucks going over this road.  Does he have a right to do this?

    Similar to my answer to your other question, it would depend on what type of road association you have, what your bylaws say, and what the deeds say.  It may also depend on whether the road up to the dead end was originally built by a developer as a private road, with the limits shown on a subdivision plan, or if it was originally a town or county way that has been discontinued, and that once continued beyond the "dead end."  Again, contact Maine ROADWays for help with the research.
