Delinquent board members?

    Should a 2 year delinquent member of a non-profit road association be allowed to be on the Board of Directors?

    Carol, The question is valid.  The answer can be simple.  If you have elections to the board, and your organization should, then the person could be replaced by another willing member (sometimes that is easier said than done).  Another possibility is enacting a bylaw that requires board members to be current with their dues.  I wouldn't recommend that.  I think it would cause more administrative headaches than it is worth.  My suggestion is to run for that board member position or attend the meeting and nominate someone else who is willing.  You can voice your concerns at the meeting as well.

    Thank you for your help Tom!

    I had read on this site that it was questionable if a delinquent member could be disqualified to vote or not but was not sure about being able to prevent him from serving on the board in order to not pay and have others not know it. 

    Another question is whether or not to let it be known who the non-paying members are.

    Nobody can be denied membership in an association who owns a parcel benefitted by the road, but an officer who does not pay can be replaced by the majority. I see no reason not to list the members who have paid and those who have not. I hope you don't really mean your $10.00 is wasted. There are many resources on this site you have access to that would not be there without the cooperation of members, and your posted question becomes one of them once you post. You are helping other people that way, not just your own association. That's the idea. Your $10.00 and that of other members goes to maintain the site.

    Thank you Betsy for your input however, I was not referring to expelling a delinquent member from the association. What I was referring to in my last reply was that somewhere on the site, someone had asked if a delinquent member.....could be prevented from voting on matters that were on the agenda.

    I apologize if I offended anyone but I will admit to being somewhat discourage at the lack of response to 3 posts of mine. Being new here I assumed that, because Maine has so many Private Roads now, that the site would have more active participation. 

    The reason I ask these questions is that I/we are in a difficult situation with our non-profit road association and I have been quite overwhelmed with learning about this job that has been pretty much dumped on me since the President and Vice President (same person) and the Treasurer/Secretary (partner of the President and VP) moved to NC but still own property in the subdivision. Dues are not paid, a lawyer MAY need to become involved and there are only 3 year round residents who have a vested interest in plowing costs - one of which is the non-paying member.

    In addition, the snowplow guy that lives on the street (not a member of our subdivision) charges us for the other 5-parcel subdivisions portion of the road even though our 10 parcel subdivision clearly states what portion we are responsible for. That makes me concerned for any liability for paying for something we are not responsible for.

    So, again I apologize for my impatience but we have not had a meeting since I have been a member and now we have a snowplowing bill that needs to get paid and a member that may have to have a lien put on his property.

    I certainly understand your frustration. I consider everyone who runs a road association (in the right way) a hero. That is why I serve MARA. I am sorry if you took my words to imply you were talking about expelling a member. I was just repeating what the law says for informational purposes.
