New utility planned to cross private road

A major utility company in central/southern Maine has purchased property on both sides of a non-public road.  We believe it is there intention to run power lines across the roadway.  At present, a road association does NOT exist over the non-public roadway in question.  I have joined the MARA to learn more about creation of an association so we can bring the road up to safe and reasonable standards.

My question is around the laws and rights around the expectation of the utility company to step up and offer concessions to help with bringing the road to reasonable standards?

    Thanks...
