    We are starting up our road association, this year, and the initial meeting involves a notary to attend. What is the form that he/she would need to notarize, to allow us to legally get our association recognized?

    On the MARA Resources Page, Conference 2020, see Mary Denison, Warrant 1st Meeting.pdf; also, suggest reading Roberta Manter’s “Warrant for First Meeting”. The notary need not attend, but must validate the Warrant. 

    Your new statutory association will have no legal “Authority” by which to be recognized. The process used in its formation and administration does need to be “in compliance” with 23 MRS, sections 3101-3104 to enable you to enforce statutory penalties for non-payment of assessments in court.

    I would also recommend going to MARA's Resources page, scroll down to paragraph 6, and take a look at the town of Windham's binder that it prepared for its residents who are looking to form road associations.  Page 3 tells you the order of filling out the various forms involved (there are a few that will be irrelevant to you that you can skip) and the binder also has samples of all the forms.  (Just pay attention to where the forms need to be changed to your town or county.)
