For the next 2 months until October 25, 2023, Statutory Road Associations may consider delaying the recording of Notices of Claim now permitted by 23 Title §3104 until October 25th, the effective date of LD 461. This delay will allow Statutory Associations to take advantage of the amendment to the Private Ways Statute that lengthens the Extension interval from 18 months to 6 years ---an interval far easier to administer.

If the parcel in delinquency is in danger of changing ownership through sale or repossession during this two month period, Attorney Mary Denison suggests recording as usual. The change of ownership may void the penalties and process offered to the association in §3104.
