Road and driveway

Trying to figure out how far into a person's driveway is still considered the road.  A friend told me that the state law is 10'.  But is that true for private roads?
The situation if there was a drainage ditch built 8' up a member's driveway from the road, it would help maintain the condition of the road.  The member cannot afford this.
If that rule stands for private roads then it would seem that funds in the Association could pay for the ditch if members voted for that.
Has anyone dealt with this situation?

As a follow up.  I received this info from a reliable legal source:
"This question can only be answered by looking at the title and deeds and perhaps a survey – the road right-of-way width is what will determine where the “road” ends and the driveway begins.  If there is a need for drainage on private property abutting a road, then the property can grant an easement for drainage to a road association (if the water is flowing from the road onto private property) or vice versa depending on the topography."
