Registering our Statutory Road Association.

    A question came up at our annual meeting: When we set up a Statutory Road Association, are we supposed to register with the Registry of Deeds?  I saw in the manual registering with MARA but nothing else.  How would a buyer on our road know about the Association?  In other words If a lawyer was doing a title search for a buyer, would it show up anywhere that they will be obligated to be part of a road association?

    Betsy:  would you kindly tell us via this forum what the answer is to the question about "registering road associations"?  I found the audio tape of the talk but it's over 90 minutes...

    There is no requirement to register with any registry of deeds and there is no requirement stated anyplace that you register with MARA. That is incorrect.

    Most, but not all, real estate agents and title companies know that many "non-public" private roads have road associations. It is smart for the association's Road Commissioner or an applicable officer to alert the listing real estate company that there is a road association. Often the listing agent will ask the association for details, such as the road maintenance fee and if there are annual meetings.
