Spouses on the Board of Directors

    We have a small 12 lot Subdivision that is trying to get the Non-Profit Association back on track. My husband and I have been the aggressors in doing the work to get this thing done. Essentially we have no elected Board of Directors at this time. (I was appointed by the previous Treasurer just before she resigned to be her assistant.) 

    Because of the time and effort that we have put into this, I am running for President and my husband is running for Treasurer. We have another couple that has decided that this is improper or not in the best interest of the association to be on the Board together. He has decided to run in order to stop that from happening even though my husband and I asked this specific question to our Association's attorney and despite the fact that there is nothing against it in the By-Laws.

    Has anyone else had members who felt that this was inappropriate or not in the best interest of the group?

    You need to bring the two slates of officers to a vote from the membership. That's all the answer you njeed, not whether other road associations have such a rule or not. Yours is free to vote its ruling on that. Do you have bylaws? They need approval by the membership.
