do people have to vote to become a statutory road association?

    Hello,
    We are following the steps to become a statutory road association from a non-profit volunteer association.  We are wondering, At the informational meeting or at the organizational meeting, are we required to hold a vote for all property members on the road to determine whether or not we can go forward with the change?  Or, can our steering committee move forth without opening it up for a vote.  AND What happens to our current non-profit road association should we vote to change to statutory?

    PLEASE GIVE SUGGESTIONS. WE DON"T WANT TO START A WAR ON OUR ROAD - Thanks everyone.

    Sorry did not reply sooner. This is an important question. You have to follow the Leadership Manual. You will see that you do not have to have a majority vote of all abutters to form under the statute. You just have to have the number stated there. Then you start to communicate with abutters and call a meeting. It should be possible to do this without a war if you have informed people why you are doing it, which I presume is to collect from all. Then, if you follow the guidelines, you can do so. There are votes taken, but the majority rules. If people choose not to participate, they still are liable for the costs if you operate correctly under the statute.

    The old road association should not need to exist but the answer to what happens to it depends on the circulmstance. Theoretically it dissolves and people pay into the new one.

    The above site has considerable very good information.

    It requires considerable leg work ahead of time but it is well worth it.

    DEP's website has been redesigned, and in the process many of the webpage addresses have been changed.  The Guide to Forming Road Associations (and associated appendices) is now available at:  http://www.maine.gov/dep/land/watershed/roadassociation.htm. 

    Many of the appendix links on the webpage noted in the previous post are broken.  It is an old version of the page and will be removed shortly.  The links on this updated page should be working.  Apologies for any inconvenience!
