    Do the declaration of covenants and restrictions supersede the By Laws of a non profit road association?

    I am not an Attorney, but I believe that if these are deeded rights or restrictions they would prevail over any provisions of Statutory Association By-laws.

    This would be a great question for the attorneys at the Conference.  I see that the question specifies non-profit road associations, while the above answer speaks of Statutory  road associations.  I am not familiar with non-profits.  It would help to have more detail about what the conflict appears to be.
